Bilindi\u011fi \u00fczere konut kiralar\u0131nda kira art\u0131\u015f\u0131n\u0131n oransal olarak \u00fcst s\u0131n\u0131r\u0131, son 12 ayl\u0131k T\u00dcFE oran\u0131d\u0131r. Ancak bu oran da arz talep aras\u0131nda ki dengesizlik sebebiyle piyasada ki art\u0131\u015f\u0131n gerisinde kalm\u0131\u015ft\u0131r. Ev sahipleri genel olarak ya T\u00fcfe oran\u0131n\u0131n \u00fcst\u00fcnde kira art\u0131\u015f\u0131 yapma yoluna ba\u015fvuruyor ya da \u00e7e\u015fitli sebeplerle eski kirac\u0131y\u0131 tahliye edip yeni kirac\u0131ya y\u00fcksek bedellerle yeniden kiralama yoluna ba\u015fvuruyorlar.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Bu yaz\u0131m\u0131zda da kiraya verenlerin s\u0131k kullanmaya ba\u015flad\u0131\u011f\u0131 gereksinim sebebiyle kiralanan\u0131n tahliyesini inceleyece\u011fiz. T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 350. maddesinde kiraya verenin konut ve \u00e7at\u0131l\u0131 i\u015f yeri niteli\u011finde ki kiralanan\u0131n gereksinim sebebiyle tahliyesi \u015fu \u015fekilde d\u00fczenlenmi\u015ftir.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">\u201c<em>Kiraya veren, kira s\u00f6zle\u015fmesini; Kiralanan\u0131 kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut ya da i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa\u2026..belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir.\u201d<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Gereksinim Sebebiyle Tahliyenin \u015eartlar\u0131<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>1. Gereksinim Olmal\u0131<\/strong><\/h4>\n\n\n\n<p class=\"has-medium-font-size\">Kiraya verenin veya kanunda say\u0131lan kiraya verenin belirli yak\u0131nlar\u0131n\u0131n kiralanan ta\u015f\u0131nmaza ihtiyac\u0131\/gereksinimi olmal\u0131d\u0131r. Kiraya veren ancak \u015fu ki\u015filerin ihtiyac\u0131n\u0131n gereksinimi oldu\u011funu belirterek kiralanan\u0131n tahliyesini isteyebilir. Bu ki\u015filer \u015funlard\u0131r:<\/p>\n\n\n\n<ul class=\"has-medium-font-size wp-block-list\">\n<li>Kiraya verenin kendisi<\/li>\n\n\n\n<li>E\u015fi<\/li>\n\n\n\n<li>Altsoyu(\u00e7ocuk-torun vs.)<\/li>\n\n\n\n<li>\u00dcstsoyu(Anne-baba-b\u00fcy\u00fckanne-b\u00fcy\u00fckbaba vs.)<\/li>\n\n\n\n<li>Kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filer<\/li>\n<\/ul>\n\n\n\n<p class=\"has-medium-font-size\">Kimlerin ihtiyac\u0131 sebebiyle kiralanan\u0131n tahliye edilebilece\u011fini belirttik. Burada dikkat \u00e7eken husus kiralayan\u0131n karde\u015finin gereksinimi olmas\u0131 hali tahliye sebebi olarak say\u0131lmam\u0131\u015f olmas\u0131d\u0131r.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Kiraya verenin bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filer ise T\u00fcrk Medeni Kanunu&#8217;nun 364\u2019\u00fcnc\u00fc maddesine g\u00f6re tayin edilir. Yukar\u0131da belirtmi\u015f oldu\u011fumuz ki\u015filer aras\u0131nda olmayan karde\u015fler bu madde uyar\u0131nca nafaka \u00f6deme \u015fartlar\u0131n\u0131n bulunmas\u0131 halinde tahliyeye sebep olu\u015fturabilir.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Gereksinim sadece konut ihtiyac\u0131 ile s\u0131n\u0131rl\u0131 de\u011fildir. \u0130\u015f yeri olarak kullan\u0131m gereksinimi de bu bak\u0131mdan tahliye davas\u0131na konu olabilir.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Ayr\u0131ca Yarg\u0131tay kararlar\u0131nda kiralaya veren ile malikin farkl\u0131 ki\u015filer olmas\u0131 halinde malikinde gereksinimi sebebiyle tahliye davas\u0131 a\u00e7abilece\u011fi belirtilmi\u015ftir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>2.Gereksinim Zorunlu, Ger\u00e7ek ve Samimi Olmal\u0131d\u0131r.<\/strong><\/h4>\n\n\n\n<p class=\"has-medium-font-size\">T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 350. maddesinde kiralayan\u0131n ihtiyac\u0131n\u0131n zorunlu olmas\u0131 gerekti\u011fi ifade edilmi\u015ftir. Buna ek olarak Yarg\u0131tay kararlar\u0131nda kiralayan\u0131n gereksiniminin ger\u00e7ek, samimi olmas\u0131 vurgulanmaktad\u0131r. Dolay\u0131s\u0131yla kiralayan\u0131n her kullan\u0131m ihtiyac\u0131 tahliye sebebi yap\u0131lamaz; ihtiyac\u0131n zorunlu, ger\u00e7ek ve samimi olmas\u0131 gerekmektedir. Bu bak\u0131mdan kiralayan\u0131n kiralanan ta\u015f\u0131nmaz\u0131n yak\u0131n\u0131nda ba\u015fka bir evi olmas\u0131 halinde kendi ihtiyac\u0131 sebebiyle kiralanan\u0131n tahliyesini talep etmesi, zorunluluktan, ger\u00e7eklikten ve samimilikten uzak oldu\u011fu d\u00fc\u015f\u00fcn\u00fclebilir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>3. Kiraya Veren Tahliye Davas\u0131 A\u00e7mal\u0131d\u0131r.<\/strong><\/h4>\n\n\n\n<p class=\"has-medium-font-size\">T\u00fcrk Bor\u00e7lar Kanunu&#8217;nda belirtilen bir ka\u00e7 istisna d\u0131\u015f\u0131nda kiralanan\u0131n tahliyesi sadece dava yoluyla yap\u0131l\u0131r. Kiralayan\u0131n gereksinimi sebebiyle tahliyede de kiralayan\u0131n dava a\u00e7mas\u0131 \u015fartt\u0131r. Gereksinimin ger\u00e7ek ve samimi olup olmad\u0131\u011f\u0131n\u0131 ve tahliye isteminin s\u00fcresinde olup olmad\u0131\u011f\u0131n\u0131 yine mahkeme karar verecektir. Mahkeme tahliye talebinin reddine veya kabul\u00fcne karar verecektir. Kirac\u0131 ancak bu karardan sonra tahliye y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc do\u011facakt\u0131r. Dolay\u0131s\u0131yla genelde s\u00f6zl\u00fc yap\u0131lan gereksinim sebebiyle tahliye bildirimi ile kirac\u0131 tahliyeye zorlanamaz. &nbsp;S\u00f6z konusu davan\u0131n a\u00e7\u0131lmas\u0131 kanunen belirli bir s\u00fcreye ba\u011flanm\u0131\u015ft\u0131r. Bu bak\u0131mdan kira s\u00f6zle\u015fmesinin belirli veya belirsiz s\u00fcreli olmas\u0131na g\u00f6re tayin edilir. Bu s\u00fcreler \u015fu \u015fekildedir;<\/p>\n\n\n\n<ul class=\"has-medium-font-size wp-block-list\">\n<li>Belirli s\u00fcreli kira s\u00f6zle\u015fmelerinde, s\u00f6zle\u015fme s\u00fcresinin sona ermesinden itibaren bir ay i\u00e7inde <\/li>\n\n\n\n<li>Belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten itibaren 1 ay i\u00e7inde <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Yeniden Kiralama Yasa\u011f\u0131<\/strong><\/h3>\n\n\n\n<p class=\"has-medium-font-size\">T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 355. maddesi \u015fu \u015fekildedir:<\/p>\n\n\n\n<p class=\"has-medium-font-size\">&nbsp;\u201c<em>Kiraya veren, gereksinim amac\u0131yla kiralanan\u0131n bo\u015falt\u0131lmas\u0131n\u0131 sa\u011flad\u0131\u011f\u0131nda, hakl\u0131 sebep olmaks\u0131z\u0131n, kiralanan\u0131 \u00fc\u00e7 y\u0131l ge\u00e7medik\u00e7e eski kirac\u0131s\u0131ndan ba\u015fkas\u0131na kiralayamaz.\u201d<\/em><\/p>\n\n\n\n<p class=\"has-medium-font-size\">Kiraya veren yukar\u0131da bahsetti\u011fimiz TBK&#8217;n\u0131n 350. maddesi uyar\u0131nca a\u00e7aca\u011f\u0131 gereksinim sebebiyle tahliye davas\u0131n\u0131 kazanmas\u0131 halinde kirac\u0131 tahliyeyi ger\u00e7ekle\u015ftirecektir. Ancak bu halde kiralanan kiraya veren taraf\u0131ndan 3 y\u0131l boyunca eski kirac\u0131s\u0131ndan ba\u015fkas\u0131na kiralanamayacakt\u0131r. Kiraya veren bu h\u00fckme ayk\u0131r\u0131 davranmas\u0131 halinde eski kirac\u0131s\u0131na tazminat \u00f6demekle y\u00fck\u00fcml\u00fc olacakt\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Yeni Malikin Gereksinimi Sebebiyle Tahliye<\/strong><\/h3>\n\n\n\n<p class=\"has-medium-font-size\">Kiralanan kira s\u00f6zle\u015fmesi s\u00fcreci i\u00e7inde el de\u011fi\u015ftirir yani malik de\u011fi\u015firse bu durumda tahliye \u015fartlar\u0131 da de\u011fi\u015fmektedir. Bu bak\u0131mdan T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 351. maddesinde belirtilen bu ki\u015filer kiralanan\u0131 kullanma gereksinimleri varsa a\u00e7acaklar\u0131 tahliye davas\u0131 ile kira s\u00f6zle\u015fmesini sonland\u0131rabilir ve kiralanandan kirac\u0131y\u0131 tahliye edebilirler. Bu bak\u0131mdan yeni malik ve yak\u0131nlar\u0131n\u0131n ihtiya\u00e7 nedeniyle tahliye davas\u0131 a\u00e7mas\u0131 ise ayr\u0131 bir yaz\u0131m\u0131z\u0131n konusudur.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Kiraya Verenin Gereksinimi Sebebiyle Kiralanan\u0131n Tahliyesiyle \u0130lgili Yarg\u0131 Kararlar\u0131<\/strong><\/h3>\n\n\n\n<ul class=\"has-medium-font-size wp-block-list\">\n<li><em>Daval\u0131lar&nbsp;gereksinim, yeniden in\u015faa ve imar amac\u0131yla bir&nbsp;tahliye&nbsp;davas\u0131 a\u00e7mam\u0131\u015ft\u0131r. Davac\u0131 kirac\u0131 ta\u015f\u0131nmaz\u0131 bir yarg\u0131 karar\u0131 veya icra marifetiyle&nbsp;tahliye&nbsp;etmemi\u015ftir. Bu durumda 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanununun 355. maddesi uyar\u0131nca tazminat ko\u015fullar\u0131 olu\u015fmam\u0131\u015ft\u0131r.<\/em>( <strong>3. Hukuk Dairesi &nbsp;&nbsp;&nbsp;&nbsp;2017\/4632 E. &nbsp;, &nbsp;2019\/1687 K.)<\/strong><\/li>\n<\/ul>\n\n\n\n<ul class=\"has-medium-font-size wp-block-list\">\n<li><em>\u0130htiya\u00e7 iddias\u0131na dayal\u0131 davalarda&nbsp;tahliyeye&nbsp;karar verilebilmesi i\u00e7in ihtiyac\u0131n ger\u00e7ek, samimi ve zorunlu oldu\u011funun kan\u0131tlanmas\u0131 gerekir. Devaml\u0131l\u0131k arz etmeyen ge\u00e7ici ihtiya\u00e7&nbsp;tahliye&nbsp;nedeni yap\u0131lamayaca\u011f\u0131 gibi, hen\u00fcz do\u011fmam\u0131\u015f veya ger\u00e7ekle\u015fmesi uzun bir s\u00fcreye ba\u011fl\u0131 olan ihtiya\u00e7 da&nbsp;tahliye&nbsp;sebebi olarak kabul edilemez. Davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 tarihte ihtiya\u00e7 sebebinin varl\u0131\u011f\u0131 yeterli olmay\u0131p, bu ihtiyac\u0131n yarg\u0131lama s\u0131ras\u0131nda da devam etmesi gerekir<\/em><strong>.( 3. Hukuk Dairesi &nbsp;2017\/7019 E. &nbsp;, 2017\/17123 K.)<\/strong> <\/li>\n<\/ul>\n\n\n\n<ul class=\"has-medium-font-size wp-block-list\">\n<li><em>Dosya kapsam\u0131ndan&nbsp;kiralanan\u0131n&nbsp;galip vasf\u0131 anla\u015f\u0131lamamaktad\u0131r. Kiralanan hakk\u0131nda uygulanacak yasa h\u00fckm\u00fcn\u00fcn belirlenmesi i\u00e7in \u00f6ncelikle&nbsp;kiralanan\u0131n&nbsp;galip vasf\u0131n\u0131n belirlenmesi gerekir. Nitekim TBK&#8217;nun 350. maddesi ancak ta\u015f\u0131nmaz\u0131n konut yada \u00e7at\u0131l\u0131 i\u015fyeri vasf\u0131nda olmas\u0131 halinde uygulanabilirken kiralanan gayrimusakkaf nitelikte ise&nbsp;gereksinim&nbsp;nedeniyle&nbsp;tahliyesi&nbsp;istenemeyece\u011fi hususu dikkate al\u0131nmaks\u0131z\u0131n eksik ara\u015ft\u0131rma ve inceleme ile karar verilmesi de do\u011fru olmam\u0131\u015ft\u0131r<strong>.<\/strong><\/em><strong>( 3.
