Bu bak\u0131mdan Cumhurba\u015fkan\u0131nca kararla\u015ft\u0131r\u0131lan riskli alanlar i\u00e7indeki yap\u0131lar i\u00e7in ise ayr\u0131 bir tespit gerekmeden riskli yap\u0131 say\u0131lacakt\u0131r.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Riskli yap\u0131lar, tapu k\u00fct\u00fc\u011f\u00fcn\u00fcn beyanlar hanesinde belirtilmek \u00fczere, tespit tarihinden itibaren en ge\u00e7 on i\u015f g\u00fcn\u00fc i\u00e7inde Bakanl\u0131k veya \u0130dare taraf\u0131ndan ilgili tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcne bildirilir. Tapu k\u00fct\u00fc\u011f\u00fcne i\u015flenen belirtmeler hakk\u0131nda, ilgili tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce ayni ve \u015fahsi hak sahiplerine bilgi verilir. Riskli yap\u0131 tespitlerine kar\u015f\u0131 maliklerce veya kanuni temsilcilerince 15 g\u00fcn i\u00e7inde itiraz edilebilir.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Riskli yap\u0131 tespitinin kesinle\u015fmesinin ard\u0131ndan y\u0131k\u0131m a\u015famas\u0131na ge\u00e7ilmektedir. Y\u0131k\u0131m a\u015famas\u0131nda ilk olarak maliklere 60 g\u00fcnden az olmamak \u00fczere s\u00fcre verilip kendilerinin y\u0131k\u0131m i\u015flemini yapmalar\u0131 istenir. E\u011fer malikler y\u0131k\u0131m\u0131 yapmazsa devreye idare girer y\u0131k\u0131m ve tahliye i\u015flemi idarece yap\u0131l\u0131r. &nbsp;Bu a\u015famada riskli yap\u0131y\u0131 kullanan kirac\u0131n\u0131n durumu \u00f6nem ta\u015f\u0131maktad\u0131r. Kirac\u0131n\u0131n sahip oldu\u011fu haklar ve y\u00fck\u00fcml\u00fcl\u00fcklerini inceleyelim.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Riskli Yap\u0131 Tespitinin Kira S\u00f6zle\u015fmesine Etkisi<\/strong><\/h4>\n\n\n\n<p class=\"has-medium-font-size\">Kira s\u00f6zle\u015fmesi, kiraya verenin bir \u015feyin kullan\u0131lmas\u0131n\u0131 veya kullanmayla birlikte ondan yararlan\u0131lmas\u0131n\u0131 kirac\u0131ya b\u0131rakmay\u0131, kirac\u0131n\u0131n da buna kar\u015f\u0131l\u0131k kararla\u015ft\u0131r\u0131lan kira bedelini \u00f6demeyi \u00fcstlendi\u011fi s\u00f6zle\u015fmedir. Kirac\u0131 \u00f6ncelikle kiraya veren ile aras\u0131nda ki kira akdi sebebiyle kiralanan\u0131 kullanma hakk\u0131na sahiptir. Kiraya verenin kiralanan\u0131n kullan\u0131m\u0131n\u0131 kirac\u0131ya tahsis etmesi ve buna katlanma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc vard\u0131r. Riskli yap\u0131 tespitinin sonucu olarak kira ili\u015fkisinde bor\u00e7lunun edimini yerine getirmesi imk\u00e2ns\u0131zla\u015fmaktad\u0131r. Bu bak\u0131mdan riskli yap\u0131 tespiti h\u00fck\u00fcmleri gere\u011fi bor\u00e7lunun kusursuz temerr\u00fcd\u00fc ger\u00e7ekle\u015fmektedir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Riskli Yap\u0131 Tespiti Halinde Kirac\u0131n\u0131n Y\u00fck\u00fcml\u00fcl\u00fckleri<\/strong><\/h4>\n\n\n\n<p class=\"has-medium-font-size\">5306 say\u0131l\u0131 kanun uyar\u0131nca riskli yap\u0131 ayni hak sahiplerine bildirilir. Ayn\u0131 hak sahiplerince \u00e7o\u011funlukla malik taraf\u0131ndan kirac\u0131ya, riskli yap\u0131 tespitini ve bu sebeple tahliye bildirimi yap\u0131lmas\u0131 gerekmektedir. Kanunda bu bildirimin \u015fekli veya yapt\u0131r\u0131m\u0131 belirtilmemi\u015ftir. Ancak malikin bu bildirimi yapmamas\u0131 halinde bu bildirimin idarece yap\u0131laca\u011f\u0131 da mevzuatta d\u00fczenlenmi\u015ftir. Dolay\u0131s\u0131yla kirac\u0131ya bu bildirim yap\u0131ld\u0131ktan sonra kirac\u0131n\u0131n riskli yap\u0131y\u0131 tahliye etmesi gerekmektedir.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Riskli yap\u0131n\u0131n niteli\u011fi ve ikamete uygun olmamas\u0131 ve y\u0131k\u0131lmas\u0131n\u0131n aciliyeti bak\u0131m\u0131ndan Bor\u00e7lar Kanunundaki tahliyeye ili\u015fkin koruyucu h\u00fck\u00fcmlerin burada uygulanmas\u0131 da m\u00fcmk\u00fcn g\u00f6r\u00fclmemektedir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Kirac\u0131 Riskli Yap\u0131y\u0131 Tahliye Etmezse Ne Olur?<\/strong><\/h4>\n\n\n\n<p class=\"has-medium-font-size\">Maliklere verilen s\u00fcrelerde y\u0131k\u0131m\u0131n ger\u00e7ekle\u015fmemesi halinde riskli yap\u0131lara elektrik, su ve do\u011falgaz verilmemesi ve verilen hizmetlerin durdurulmas\u0131 ilgili kurum ve kurulu\u015flardan istenir. Dolay\u0131s\u0131yla maliklere verilen 60 g\u00fcnl\u00fck s\u00fcre dolmu\u015f ve y\u0131k\u0131m\u0131n ger\u00e7ekle\u015fmemi\u015f kirac\u0131 riskli yap\u0131da ikametine devam ediyorsa elektrik, su ve do\u011falgaz\u0131n kesilmesi sebebiyle ma\u011fdur olacakt\u0131r.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Ek olarak ifade etmek isteriz ki maliklerin y\u0131k\u0131m\u0131 ger\u00e7ekle\u015ftirmemesi durumunda idarenin kolluk biriminden destek alarak riskli yap\u0131y\u0131 y\u0131kt\u0131rma ve tahliye etme yetkisi de vard\u0131r.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Ayr\u0131ca yine 6306 say\u0131l\u0131 Kanun 8. maddesinin 4. Bendi uyar\u0131ncariskli yap\u0131lar\u0131n tespiti, tahliyesi ve y\u0131kt\u0131rma i\u015f ve i\u015flemlerini engelleyenler hakk\u0131nda \u0130darece veya M\u00fcd\u00fcrl\u00fck\u00e7e tutanak tutulur ve bunlar hakk\u0131nda, 26\/9\/2004 tarihli ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanununun ilgili h\u00fck\u00fcmleri uyar\u0131nca Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131na su\u00e7 duyurusunda bulunulur.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Riskli Yap\u0131 Tespiti Halinde Kirac\u0131n\u0131n Haklar\u0131<\/strong><\/h4>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>1. Kirac\u0131n\u0131n Kira S\u00f6zle\u015fmesini Feshetme Hakk\u0131<\/strong><\/h5>\n\n\n\n<p class=\"has-medium-font-size\">Yukar\u0131da kirac\u0131n\u0131n riskli yap\u0131y\u0131 tahliye etmesi y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcnden bahsettik. Ancak kirac\u0131n\u0131n kira s\u00f6zle\u015fmesini feshederek kiralanan\u0131 tahliye etmesi ayn\u0131 zamanda bir hakt\u0131r. 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 301\u2019inci maddesine g\u00f6re kiraya veren kiralanan\u0131 <em>s\u00f6zle\u015fmede ama\u00e7lanan kullan\u0131ma elveri\u015fli bir durumda teslim etmek ve s\u00f6zle\u015fme s\u00fcresince bu durumda bulundurmakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/em> T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 306\u2019\u0131nc\u0131 maddesinin ikinci f\u0131kras\u0131na g\u00f6re de <em>ay\u0131b\u0131n<strong>,&nbsp;<\/strong><\/em><strong><em>kiralanan\u0131n \u00f6ng\u00f6r\u00fclen kullan\u0131ma elveri\u015flili\u011fini ortadan kald\u0131rmas\u0131 ya da \u00f6nemli \u00f6l\u00e7\u00fcde engellemesi ve verilen s\u00fcrede giderilmemesi h\u00e2linde kirac\u0131<\/em><\/strong><em><strong>,&nbsp;<\/strong><\/em><strong><em>s\u00f6zle\u015fmeyi feshedebilir<\/em><\/strong><em>. Dolay\u0131s\u0131yla riskli yap\u0131 tespitinin kesinle\u015fmesinden sonra kiralanan\u0131n kullan\u0131ma elveri\u015fli olmad\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan kirac\u0131 kira s\u00f6zle\u015fmesini feshetme hakk\u0131na sahiptir.<\/em><\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>2. Kirac\u0131n\u0131n Kira Yard\u0131m\u0131 Alma Hakk\u0131<\/strong><\/h5>\n\n\n\n<p class=\"has-medium-font-size\"> 6306 say\u0131l\u0131 Afet Riski Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi Hakk\u0131nda Kanun kapsam\u0131nda riskli yap\u0131da ikamet eden kirac\u0131lar i\u00e7in kira yard\u0131m\u0131 hakk\u0131 tan\u0131nm\u0131\u015ft\u0131r. <\/p>\n\n\n\n<ul class=\"has-medium-font-size wp-block-list\"><li><strong>\u015eartlar\u0131<\/strong><\/li><\/ul>\n\n\n\n<p class=\"has-medium-font-size\">\u00d6ncelikle riskli yap\u0131 tespit tarihinde kirac\u0131n\u0131n riskli yap\u0131da ikamet ediyor olmas\u0131 gerekir ve bu tespit sonras\u0131nda  riskli yap\u0131n\u0131n anla\u015fma ile tahliye edilmi\u015f olmas\u0131 gerekir.  Kira yard\u0131m\u0131ndan faydalanmak i\u00e7in tahliye tarihinden itibaren bir y\u0131l i\u00e7inde veya riskli yap\u0131n\u0131n y\u0131kt\u0131r\u0131ld\u0131\u011f\u0131 tarihten itibaren \u00fc\u00e7 ay i\u00e7inde, riskli yap\u0131n\u0131n bulundu\u011fu ildeki il\u00e7e belediyesine ba\u015fvurulmas\u0131 gerekir.<\/p>\n\n\n\n<ul class=\"has-medium-font-size wp-block-list\"><li><strong>Kirac\u0131 \u0130\u00e7in Kira Yard\u0131m Miktar\u0131<\/strong><\/li><\/ul>\n\n\n\n<p class=\"has-medium-font-size\">Kira yard\u0131m s\u00fcresi malikler i\u00e7in 18 ay olup konut\/i\u015fyerinde kirac\u0131 olarak ikamet edenlerde ise bu s\u00fcre 2 ayd\u0131r. Yap\u0131n\u0131n bulundu\u011fu ilde malikler i\u00e7in belirlenen ayl\u0131k kira yard\u0131m\u0131 tutar\u0131 esas al\u0131narak 2 ayl\u0131k kira yard\u0131m\u0131 hesaplan\u0131r ve tek seferde \u00f6denir.<\/p>\n\n\n\n<ul class=\"has-medium-font-size wp-block-list\"><li><strong>Ba\u015fvuruya \u0130li\u015fkin Notlar<\/strong><\/li><\/ul>\n\n\n\n<p class=\"has-medium-font-size\">Ba\u015fvuru belgeleri riskli yap\u0131 da ikamet edilmesi ile i\u015fyeri i\u015fletilmesi halleri farkl\u0131l\u0131klar i\u00e7ermektedir. Bu sebeple iki ayr\u0131 ba\u015fl\u0131k alt\u0131nda d\u00fczenlenmi\u015ftir.
