Bug\u00fcnde son derece g\u00f6r\u00fcn\u00fcr olmu\u015f ve gerek tahliye davalar\u0131 ile birlikte gerek tek ba\u015f\u0131na ikame edildi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Kira Tespit Davas\u0131 Nedir?<\/strong><\/h4>\n\n\n\n<p>Kira tespit davalar\u0131, taraflar aras\u0131ndaki kira ili\u015fkisinde ba\u015flang\u0131\u00e7ta belirlenen kira bedelinin mahkeme taraf\u0131ndan tespiti amac\u0131yla ikame edilen davalard\u0131r. Hukuki t\u00fcr olarak tespit davas\u0131 yani bir \u015feyi yapmaya veya vermeye h\u00fckmedilmeyen sadece tespit talebi \u00e7er\u00e7evesinde tespit i\u015flemi ile s\u0131n\u0131rl\u0131 davalard\u0131r. Yarg\u0131tay i\u00e7tihatlar\u0131 do\u011frultusunda s\u00f6z konusu davan\u0131n in\u015fai bir dava oldu\u011fu ifade edilmektedir.<\/p>\n\n\n\n<p>Bu t\u00fcr davalarda toplanmas\u0131 gerekli belgeler ve ispata muhta\u00e7 hususlar giderildikten sonra kira  tespiti istenen ta\u015f\u0131nmaz bak\u0131m\u0131ndan ke\u015fif yap\u0131larak, hesaplama yap\u0131lmas\u0131 ve rapor haz\u0131rlanmas\u0131 i\u00e7in bilirki\u015fiye tevdii edilir.  Hakim bilirki\u015fi raporundan da faydalanarak dava sonunda karar verecektir. <\/p>\n\n\n\n<p>S\u00f6z konusu davaya ili\u015fkin a\u00e7\u0131klamalara ge\u00e7emden \u00f6nce kira s\u00f6zle\u015fmesinde ne kadar zam yap\u0131labilece\u011fi hususuna de\u011finmemiz gerekmektedir. T\u00fcrk Bor\u00e7lar Kanunu&#8217;n 344. maddesine g\u00f6re taraflar kira s\u00f6zle\u015fmesinde gelecek d\u00f6nemlere ili\u015fkin kira art\u0131\u015f oranlar\u0131n\u0131 kanuni s\u0131n\u0131rlar dahilinde serbest\u00e7e belirleyebilmektedirler. Taraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u0131, son 12 ayl\u0131k  t\u00fcketici fiyat endeksindeki (T\u00dcFE) art\u0131\u015f oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla ge\u00e7erlidir. Ayr\u0131ca Temmuz 2022- Temmuz 2023 aras\u0131 kira art\u0131\u015f oran\u0131n\u0131n %25 s\u0131n\u0131r\u0131 koyuldu\u011funu da hat\u0131rlatmak isteriz.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Kira Tespit Davas\u0131 A\u00e7\u0131lmas\u0131n\u0131n \u015eartlar\u0131 Nelerdir? <\/strong><\/h4>\n\n\n\n<p>Kira tespit davalar\u0131 temelde iki kategoride incelemek m\u00fcmk\u00fcnd\u00fcr. Kira ili\u015fkisinin 5 y\u0131l\u0131 doldurup dolmad\u0131\u011f\u0131 hususuna g\u00f6re farkl\u0131 hukuki sonu\u00e7lara var\u0131labilmektedir. E\u011fer kira s\u00f6zle\u015fmesinde devam eden y\u0131llar i\u00e7in art\u0131\u015f oran\u0131 belirlendiyse s\u00f6zle\u015fmenin ilk 5 y\u0131l\u0131nda kira art\u0131\u015f oran\u0131 talebinde bulunulmas\u0131nda hukuki yarar bulunmamaktad\u0131r. Ancak kira s\u00f6zle\u015fmesinde bu y\u00f6nde bir belirleme yap\u0131lmad\u0131ysa ilk 5 y\u0131l i\u00e7indede taraflar mahkemeden kira bedelinin tespitini talep edebilecektir. Ancak mahkemece yap\u0131lacak bu tespit yine kanunda \u00f6ng\u00f6r\u00fclen kira art\u0131\u015f oran\u0131 yani 12 ayl\u0131k T\u00fcfe oran\u0131 ve ge\u00e7ici madde ile konulmu\u015f olan %25&#8217;lik oranla s\u0131n\u0131rl\u0131 olarak yap\u0131labilecek olup mahkemece bu oran\u0131n \u00fcst s\u0131n\u0131r\u0131nda tespit yapma zorunlulu\u011fu bulunmamakta olup kiralanan\u0131n durumu da g\u00f6zetilerek hakkaniyete g\u00f6re bir tespit yapacakt\u0131r.<\/p>\n\n\n\n<p>E\u011fer kira s\u00f6zle\u015fmesinin \u00fczerinden 5 y\u0131l ge\u00e7mi\u015fse; taraflarca art\u0131\u015f oran\u0131 bak\u0131m\u0131ndan bir anla\u015fma yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n, yeni kira y\u0131l\u0131nda uygulanacak kira bedeli, h\u00e2kim taraf\u0131ndan 12 ayl\u0131k t\u00fcketici fiyat endeksindeki art\u0131\u015f ortalamas\u0131, kiralanan\u0131n durumu ve emsal kira bedelleri g\u00f6z \u00f6n\u00fcnde tutularak hakkaniyete uygun bi\u00e7imde belirlenmesi m\u00fcmk\u00fcnd\u00fcr.<\/p>\n\n\n\n<p>G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere 5 y\u0131l dolmad\u0131ysa hakim kanundaki kira art\u0131\u015f oranlar\u0131 s\u0131n\u0131rlamalar\u0131 dahilinde bir kira tespitinde bulunma yetkisi varken 5 y\u0131l dolduktan sonra ise esas \u00f6l\u00e7\u00fc hakkaniyet olmak \u00fczere kanuni kira art\u0131\u015f s\u0131n\u0131r\u0131,  kiralanan\u0131n durumu ve emsal kira bedelleri gibi hususlar de\u011ferlendirmede g\u00f6z\u00f6n\u00fcnde bulundurulacak hususlar olarak say\u0131lm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla e\u011fer 5 y\u0131l ge\u00e7mi\u015fse hakim 12 ayl\u0131k t\u00fcketici fiyat endeksindeki art\u0131\u015f ortalamas\u0131n\u0131n \u00fczerinde bir kira tespit etme imkan\u0131 bulunmaktad\u0131r. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Tespit Davas\u0131n\u0131 Ne Zaman A\u00e7abilirim?<\/strong> <strong>Tespit Hangi Tarihten \u0130tibaren Yap\u0131l\u0131r?<\/strong><\/h4>\n\n\n\n<p>Kural olarak tespit davas\u0131 her zaman a\u00e7\u0131labilir. Ancak hem esas al\u0131nacak d\u00f6nem hem de talep sonucu bak\u0131m\u0131ndan davan\u0131n ikame edildi\u011fi tarih \u00f6nem te\u015fkil etmektedir.<\/p>\n\n\n\n<p>Kira tespit davas\u0131, yeni d\u00f6nemin ba\u015flang\u0131c\u0131ndan en ge\u00e7 otuz g\u00fcn \u00f6nceki bir tarihte a\u00e7\u0131ld\u0131\u011f\u0131 ya da kiraya veren taraf\u0131ndan bu s\u00fcre i\u00e7inde kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin olarak kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunulmu\u015f olmas\u0131 ko\u015fuluyla, izleyen yeni kira d\u00f6nemi sonuna kadar a\u00e7\u0131ld\u0131\u011f\u0131 takdirde, mahkemece belirlenecek kira bedeli, bu yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan itibaren uygulanmak \u00fczere tespit edilecektir. <\/p>\n\n\n\n<p>Sonu\u00e7 olarak; TBK.m.345\/2&#8217;ye g\u00f6re mahkemenin kira bedelinin tespit karar\u0131 yeni kira y\u0131l\u0131nda uygulanabilmesi i\u00e7in kiraya verenin se\u00e7imlik iki ko\u015fuldan birini yerine getirmesi gerekir. Buna g\u00f6re,<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Yeni kira d\u00f6nemimin ba\u015flamas\u0131na en ge\u00e7&nbsp;otuz g\u00fcn&nbsp;kala tespit davas\u0131n\u0131 a\u00e7mal\u0131,<\/li>\n\n\n\n<li>Ya da ayn\u0131 s\u00fcreye uyarak kira bedelinin art\u0131r\u0131laca\u011f\u0131n\u0131&nbsp;yaz\u0131l\u0131 olarak kirac\u0131ya bildirmelidir.<\/li>\n<\/ul>\n\n\n\n<p>Mevzubahis  s\u00fcre ko\u015fuluna uymadan a\u00e7\u0131lan davalarda Yarg\u0131tay uygulamas\u0131 do\u011frultusunda \u015fartlar\u0131 olu\u015fmayan d\u00f6nem izleyen kira d\u00f6neminde s\u00f6z konusu tespitin yap\u0131lmas\u0131n\u0131 talep edip etmedi\u011fi sorularak davada sonuca gidilebilmektedir.<br><br>Yukar\u0131da belirtmi\u015f oldu\u011fumuz kira tespit davas\u0131nda ki s\u00fcre \u015fart\u0131n\u0131n istisnas\u0131 yine kanunda d\u00fczenlenmi\u015ftir. Bu halde s\u00f6zle\u015fmede yeni kira d\u00f6neminde kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin bir h\u00fck\u00fcm varsa, yeni kira d\u00f6neminin sonuna kadar a\u00e7\u0131lacak davada mahkemece belirlenecek kira bedeli de, bu yeni d\u00f6nemin ba\u015flang\u0131c\u0131ndan itibaren ge\u00e7erli uygulanmak \u00fczere tespit edilebilecektir.  Bu konuda belirli bir art\u0131\u015f oran\u0131n olup olmad\u0131\u011f\u0131na ili\u015fkin a\u00e7\u0131klama ve yarg\u0131 kararlar\u0131na ula\u015fmak i\u00e7in <a href=\"http:\/\/www.avberkayakdag.com\/?p=1061\">Kiralayan Ge\u00e7mi\u015fe D\u00f6n\u00fck Kira Art\u0131\u015f Farklar\u0131n\u0131 Talep Edilebilir Mi?<\/a> yaz\u0131m\u0131z\u0131 okuyabilirsiniz.<\/p>\n\n\n\n<p>Ayr\u0131ca kira tespit davalar\u0131 nitelikli davalar olup kira s\u00f6zle\u015fmesinin ve di\u011fer hukuki arg\u00fcmanlar\u0131n diikatl incelenerek yol haritas\u0131n\u0131n \u00e7\u0131kar\u0131lmas\u0131 gerekmektedir. Bu bak\u0131m\u0131nda hukuki destek alarak y\u00fcr\u00fct\u00fclmesi do\u011fru ve istenilen sonuca ula\u015f\u0131lmas\u0131 i\u00e7in m\u00fchimdir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Konuyla \u0130lgili Yarg\u0131 Kararlar\u0131<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>&#8220;Daha \u00f6nce de belirtildi\u011fi gibi kira bedelinin tespiti davalar\u0131 kendine \u00f6zg\u00fc bir dava olup in\u015fai davalar sonunda verilen kararlara yak\u0131n bir niteliktedir. Bu davalarda sadece ilgili kira d\u00f6neminde ge\u00e7erli olacak kira bedelinin tespiti istenir ve kira bedelinin tespiti davas\u0131n\u0131n s\u0131n\u0131rl\u0131 bir konusu vard\u0131r. Dava sonucunda h\u00e2kim, ileriye y\u00f6nelik olarak bir y\u0131ll\u0131k s\u00fcre zarf\u0131nda uygulanacak olan kira bedelini belirler ve kira s\u00f6zle\u015fmesinde yer alan kira bedeli, h\u00e2kim karar\u0131 ile de\u011fi\u015ftirilmi\u015f olur. Davan\u0131n bu niteli\u011fi gere\u011fince kira bedelinin tespitine ili\u015fkin talep b\u00f6l\u00fcnemez ve kira bedeli davac\u0131 taraf\u0131ndan bir seferde a\u00e7\u0131k ve net olarak istenilmesi gerekir.&#8221; <\/em><strong>(Yarg\u0131tay Hukuk Genel Kurulu E. 2017\/6-2792 K. 2021\/267 T. 16.3.2021)<\/strong><br><\/li>\n\n\n\n<li><em>&#8220;Davac\u0131 dava konusu ta\u015f\u0131nmazda payda\u015f olup, payl\u0131 m\u00fclkiyette her payda\u015f kendi pay\u0131 oran\u0131nda kira bedelinin tespitini isteyebilir. Davac\u0131 da dava dilek\u00e7esinde pay\u0131 oran\u0131nda kira bedelinin tespitini talep etmi\u015ftir. Bu durumda Mahkemece, payl\u0131 m\u00fclkiyete tabi ta\u015f\u0131nmazlarda payda\u015f\u0131n sadece kendi pay\u0131 i\u00e7in kira tespiti davas\u0131 a\u00e7abilece\u011fi g\u00f6z\u00f6n\u00fcnde bulundurularak davac\u0131n\u0131n pay\u0131 oran\u0131nda kira bedelinin tespitine karar verilmesi gerekirken ta\u015f\u0131nmaz\u0131n tamam\u0131 i\u00e7in kira bedelinin tespitine karar verilmesi do\u011fru g\u00f6r\u00fclmemi\u015f, bozmay\u0131 gerektirmi\u015ftir&#8221; <\/em><strong>(Yarg\u0131tay 3.
