Bu hususta gerek y\u00f6neticilerin gerek di\u011fer kom\u015fular\u0131n ev sahiplerine kirac\u0131lar\u0131n\u0131n g\u00fcr\u00fclt\u00fc yapt\u0131\u011f\u0131 veya ba\u015fkaca rahats\u0131zl\u0131klar verdi\u011fi \u015feklinde \u015fikayetlerin geldi\u011fini bir \u00e7ok kez duymaktay\u0131z. <\/p>\n\n\n\n<p>Bu konu ba\u015fl\u0131\u011f\u0131 bak\u0131m\u0131ndan \u00f6nceli\u011fimiz T\u00fcrk Bor\u00e7lar Kanunu&#8217;na g\u00f6re ne yap\u0131labilece\u011fi olacakt\u0131r. Ancak yine Kabahatler Kanunu, Ceza Kanunu ve Kat M\u00fclkiyeti Kanunu&#8217;ndaki hukuki imkanlara k\u0131saca de\u011finilecektir.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">G\u00fcr\u00fclt\u00fc Yapan Kirac\u0131 Tahliye Edilebilir Mi?<\/h2>\n\n\n\n<p>T\u00fcrk Bor\u00e7lar Kanunu kirac\u0131ya genel kira \u00f6deme borcu, temizlik ve bak\u0131m giderlerini \u00f6deme borcu ve \u00f6zenle kullanma ve kom\u015fulara sayg\u0131 g\u00f6sterme gibi bir tak\u0131m y\u00fck\u00fcml\u00fcl\u00fckler y\u00fcklenmi\u015ftir. Bu hususlar aras\u0131nda bug\u00fcnk\u00fc yaz\u0131m\u0131zla ilgili olan y\u00fck\u00fcml\u00fcl\u00fck ise \u00f6zenle kullanma ve kom\u015fulara sayg\u0131 g\u00f6sterme borcudur.  G\u00fcr\u00fclt\u00fc yapma veya di\u011fer bu nevi hususlar kom\u015fulara sayg\u0131 g\u00f6sterme borcuna ayk\u0131r\u0131l\u0131k te\u015fkil edebilmektedir.<\/p>\n\n\n\n<p>TBK m. 316 \u015fu \u015fekildedir:<br><em>&#8220;Kirac\u0131, kiralanan\u0131, s\u00f6zle\u015fmeye uygun olarak \u00f6zenle kullanmak ve<br>kiralanan\u0131n bulundu\u011fu ta\u015f\u0131nmazda oturan ki\u015filer ile kom\u015fulara gerekli sayg\u0131y\u0131 g\u00f6stermekle y\u00fck\u00fcml\u00fcd\u00fcr.&#8221;<\/em><\/p>\n\n\n\n<p>Kanun koyucu kirac\u0131ya s\u00f6z konusu borcu y\u00fckledikten sonra kirac\u0131n\u0131n \u00f6zenle kullanma ve kom\u015fulara sayg\u0131 g\u00f6stermemesi halinde olacak hususlar hakk\u0131nda da belirlemeler yapm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p><em>&#8220;Kirac\u0131n\u0131n bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne ayk\u0131r\u0131 davranmas\u0131 durumunda kiraya veren, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiras\u0131nda, en az otuz g\u00fcn s\u00fcre vererek, ayk\u0131r\u0131l\u0131\u011f\u0131n giderilmesi, aksi takdirde s\u00f6zle\u015fmeyi feshedece\u011fi konusunda yaz\u0131l\u0131 bir ihtarda bulunur. Di\u011fer kira ili\u015fkilerinde ise, kiraya veren, kirac\u0131ya \u00f6nceden bir ihtarda bulunmaks\u0131z\u0131n, yaz\u0131l\u0131 bir bildirimle s\u00f6zle\u015fmeyi hemen feshedebilir.<\/em><br><em><br>Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiras\u0131nda, kirac\u0131n\u0131n kiralanana kasten a\u011f\u0131r bir zarar vermesi, kirac\u0131ya verilecek s\u00fcrenin yarars\u0131z olaca\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 veya kirac\u0131n\u0131n bu y\u00fck\u00fcml\u00fcl\u00fc\u011fe ayk\u0131r\u0131 davran\u0131\u015f\u0131n\u0131n kiraya veren veya ayn\u0131 ta\u015f\u0131nmazda oturan ki\u015filer ile kom\u015fular bak\u0131m\u0131ndan \u00e7ekilmez olmas\u0131 durumlar\u0131nda kiraya veren, yaz\u0131l\u0131 bir bildirimle s\u00f6zle\u015fmeyi hemen feshedebilir.&#8221;<\/em><\/p>\n\n\n\n<p>G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere kanun koyucunun kirac\u0131n\u0131n \u00f6zenle kullan\u0131m ve kom\u015fulara sayg\u0131 y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne ayk\u0131r\u0131 davran\u0131lmas\u0131na y\u00fckledi\u011fi sonu\u00e7 s\u00f6zle\u015fmenin feshedilmesi dolay\u0131s\u0131yla tahliyedir. Ancak bunun i\u00e7in \u00f6ncelikle ihtar \u00e7ekilerek kiran\u0131n uyar\u0131lmas\u0131 gerekti\u011fi ifade edilmi\u015ftir. Uygulamada \u00e7ok s\u0131k ihtarname ke\u015fide edilmekte ancak bunlar\u0131n bir \u00e7o\u011fu ihtiyari olmaktad\u0131r. Ancak g\u00f6r\u00fcld\u00fc\u011f\u00fc gibi \u00f6zen y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne ayk\u0131r\u0131l\u0131kta ihtarname zorunlu unsur olarak belirtilmi\u015ftir.<\/p>\n\n\n\n<p>Ancak madde metninde ifade edildi\u011fi \u00fczere baz\u0131 hallerde ihtarname g\u00f6nderilmesine gerek olamadan s\u00f6zle\u015fme derhal feshedilebilir. Bu haller \u015fu \u015fekildedir:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Kirac\u0131n\u0131n kiralanana kasten a\u011f\u0131r bir zarar vermesi durumunda<\/li>\n\n\n\n<li>Kirac\u0131ya verilecek s\u00fcrenin yarars\u0131z olaca\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 durumunda<\/li>\n\n\n\n<li>Kirac\u0131n\u0131n \u00f6zen ve sayg\u0131 y\u00fck\u00fcml\u00fcl\u00fc\u011fe ayk\u0131r\u0131 davran\u0131\u015f\u0131n\u0131n kiraya veren veya ayn\u0131 ta\u015f\u0131nmazda oturan ki\u015filer ile kom\u015fular bak\u0131m\u0131ndan \u00e7ekilmez olmas\u0131 durumunda<\/li>\n<\/ul>\n\n\n\n<p>Yarg\u0131tay uygulamas\u0131 bak\u0131m\u0131ndan s\u00fcre vermenin yarars\u0131z olmas\u0131 ve y\u00fck\u00fcml\u00fcl\u00fc\u011fe ayk\u0131r\u0131 davranman\u0131n \u00e7ekilmez halde olmas\u0131n\u0131n de\u011ferlendirilmesi s\u0131n\u0131rl\u0131 bir kapsamda uygulanmaktad\u0131r. Bu bak\u0131mdan s\u00f6z konusu \u00f6zen ve kom\u015fulara sayg\u0131 y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne ayk\u0131r\u0131 davran\u0131lmas\u0131 halinde zarara yol a\u00e7mayacaksa \u00f6nce ihtar \u00e7ekilmesi makul g\u00f6r\u00fcnmektedir. Dolay\u0131s\u0131yla ba\u015fl\u0131kta sormu\u015f oldu\u011fumuz sorunun cevab\u0131n\u0131n verecek olursak evet g\u00fcr\u00fclt\u00fc yapan kirac\u0131 tahliye edilebilir. Ancak g\u00fcr\u00fclt\u00fcn\u00fcn niteli\u011fi, d\u00fczeyi, s\u0131kl\u0131\u011f\u0131 mahkemece de\u011ferlendirilip usulen yerine getirilmesi gereken ihtar ve di\u011fer \u015fartlar\u0131nda yerine getirilip getirilmedi\u011fi  tespit edilip bu bak\u0131mdan bir karar verilecektir. Ancak yine de g\u00fcr\u00fclt\u00fc bak\u0131m\u0131ndan  ho\u015fg\u00f6r\u00fc ve tahamm\u00fcl s\u0131n\u0131r\u0131 \u00f6nem te\u015fkil etti\u011fini ifade etmek isteriz.<\/p>\n\n\n\n<p>Bu b\u00f6l\u00fcmde aktard\u0131\u011f\u0131m\u0131z hususlar yaln\u0131zca g\u00fcr\u00fclt\u00fc yap\u0131lmas\u0131 hususuyla s\u0131n\u0131rl\u0131 de\u011fildir. Yine kirac\u0131n\u0131n kom\u015fulara veya kiraya verene kar\u015f\u0131 tehdit, kasten yaralama gibi fiiller i\u015flemesi de bu kapsamda de\u011ferlendirilebilir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Kabahatler Kanunu Bak\u0131m\u0131ndan De\u011ferlendirme<\/h3>\n\n\n\n<p>Kirac\u0131n\u0131n kom\u015fular\u0131n\u0131 rahats\u0131z edecek nitelikte g\u00fcr\u00fclt\u00fc yap\u0131lmas\u0131 Kabahatler Kanunu\u2019nda g\u00fcr\u00fclt\u00fc ba\u015fl\u0131\u011f\u0131 alt\u0131nda d\u00fczenlenmeye g\u00f6re idari para cezas\u0131 yapt\u0131r\u0131m\u0131na tabi k\u0131l\u0131nm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>5326 Say\u0131l\u0131 Kabahatler Kanunu&#8217;n 36. maddesinde ba\u015fkalar\u0131n\u0131n huzur ve s\u00fckununu bozacak \u015fekilde g\u00fcr\u00fclt\u00fcye neden olan ki\u015fiye, elli T\u00fcrk Liras\u0131 idar\u00ee para cezas\u0131 verilece\u011fi belirtilmi\u015ftir. 2022 y\u0131l\u0131nda s\u00f6z konusu para cezas\u0131n\u0131n g\u00fcncel tutar\u0131 277 TL&#8217;dir.<\/p>\n\n\n\n<p>S\u00f6z konusu para cezas\u0131n\u0131n verilmesi kolluk ve zab\u0131ta birimlerince verilebilmektedir. S\u00f6z konusu para cezas\u0131n\u0131n verilmesi muhtemelen sorunu \u00e7\u00f6zmeyecektir. Ancak ileride ya\u015fanabilecek bir hukuki uyu\u015fmazl\u0131kta yol g\u00f6sterici olma niteli\u011fine haizdir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ceza Kanunu Bak\u0131m\u0131ndan De\u011ferlendirme<\/h3>\n\n\n\n<p>Kirac\u0131n\u0131n kom\u015fular\u0131n\u0131 rahats\u0131z edecek nitelikte g\u00fcr\u00fclt\u00fc yap\u0131lmas\u0131 ve bu g\u00fcr\u00fclt\u00fcn\u00fcn kasten ba\u015fkalar\u0131n\u0131n huzurunu bozmak i\u00e7in yap\u0131lmas\u0131 halinde s\u00f6z konusu fiil TCK m. 123 kapsam\u0131na girecektir. Bu halde   \u00e7ereye rahats\u0131zl\u0131k verenler hakk\u0131nda savc\u0131l\u0131\u011fa ba\u015fvurularak su\u00e7 duyurusunda da bulunulabilir. <br><br>Ki\u015filerin huzur ve s\u00fckununu bozma su\u00e7u 5237 Say\u0131l\u0131 T\u00fcrk Ceza Kanunu 123. maddede: <em>\u201cS\u0131rf huzur ve s\u00fck\u00fbnunu bozmak maksad\u0131yla bir kimseye \u0131srarla; telefon edilmesi, g\u00fcr\u00fclt\u00fc yap\u0131lmas\u0131 ya da ayn\u0131 maksatla hukuka ayk\u0131r\u0131 ba\u015fka bir davran\u0131\u015fta bulunulmas\u0131 halinde, ma\u011fdurun \u015fikayeti \u00fczerine faile \u00fc\u00e7 aydan bir y\u0131la kadar hapis cezas\u0131 verilir.\u201d<\/em> \u015feklinde d\u00fczenlenmi\u015ftir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Kat M\u00fclkiyeti Kanunu Bak\u0131m\u0131ndan De\u011ferlendirme<\/h3>\n\n\n\n<p>Kat M\u00fclkiyeti Kanunu\u2019nda (KMK) kom\u015fuluk ili\u015fkisini d\u00fczenleyen \u00e7ok say\u0131da h\u00fck\u00fcm bulunmaktad\u0131r. Nitekim KMK\u2019n\u0131n 18. maddesine g\u00f6re;<\/p>\n\n\n\n<p><em>\u201cKat malikleri, gerek ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerini, gerek eklentileri ve ortak yerleri kullan\u0131rken do\u011fruluk kaidelerine uymak, \u00f6zellikle birbirini rahats\u0131z etmemek, birbirinin haklar\u0131n\u0131 \u00e7i\u011fnememek ve y\u00f6netim plan\u0131 h\u00fck\u00fcmlerine uymakla, kar\u015f\u0131l\u0131kl\u0131 olarak y\u00fck\u00fcml\u00fcd\u00fcrler.&#8221;<\/em><\/p>\n\n\n\n<p>Maddede ifade edilen y\u00fck\u00fcml\u00fcl\u00fckler ayn\u0131 zamanda kirac\u0131lar i\u00e7inde ge\u00e7erli olup bu y\u00fck\u00fcml\u00fcl\u00fcklere uygun davranmak zorundalard\u0131r. Kirac\u0131n\u0131n bu y\u00fck\u00fcml\u00fcl\u00fc\u011fe ayk\u0131r\u0131 davranmas\u0131 halinde ise kat malikleri y\u00f6netimi taraf\u0131ndan kirac\u0131ya ihtarname g\u00f6nderilebilir ve sonras\u0131nda s\u00f6z konusunu m\u00fcdahalenin giderilmesi mahkemeden istenebilecektir. \u0130kame edilecek davada, kirac\u0131n\u0131n rahats\u0131zl\u0131k verici davran\u0131\u015f\u0131n \u00f6nlenmesi ya da sonland\u0131r\u0131lmas\u0131 talep edilebilecektir. Ayr\u0131ca yine bu kanuna g\u00f6re \u015fartlar\u0131n\u0131n olu\u015fmas\u0131 halinde idari para cezas\u0131 ve ta\u015f\u0131nmaz\u0131n di\u011fer kat maliklerine devride talep edilebilecektir.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Konuyla \u0130lgili Yarg\u0131 Kararlar\u0131<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>&#8220;BK.nun 316. maddesinin 1.f\u0131kras\u0131nda \u201cKirac\u0131, kiralanan\u0131, s\u00f6zle\u015fmeye uygun olarak \u00f6zenle kullanmak ve kiralanan\u0131n bulundu\u011fu ta\u015f\u0131nmazda oturan ki\u015filer ile kom\u015fulara gerekli sayg\u0131y\u0131 g\u00f6stermekle y\u00fck\u00fcml\u00fcd\u00fcr.\u201d h\u00fckm\u00fc, yine ayn\u0131 maddenin 3. f\u0131kras\u0131nda \u201cKonut ve \u00e7at\u0131l\u0131 i\u015fyeri kiras\u0131nda, kirac\u0131n\u0131n kiralanana kasten a\u011f\u0131r bir zarar vermesi, kirac\u0131ya verilecek s\u00fcrenin yarars\u0131z olaca\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 veya kirac\u0131n\u0131n bu y\u00fck\u00fcml\u00fcl\u00fc\u011fe ayk\u0131r\u0131 davran\u0131\u015f\u0131n\u0131n kiraya veren veya ayn\u0131 ta\u015f\u0131nmazda oturan ki\u015filer ile kom\u015fular bak\u0131m\u0131ndan \u00e7ekilmez olmas\u0131 durumlar\u0131nda kiraya veren, yaz\u0131l\u0131 bir bildirimle s\u00f6zle\u015fmeyi hemen feshedebilir.\u201d h\u00fckm\u00fc yer almaktad\u0131r. Somut olayda BK.nun 316. maddesinde belirtilen, kirac\u0131n\u0131n kiraya veren veya ayn\u0131 ta\u015f\u0131nmazda oturan ki\u015filer ile kom\u015fular bak\u0131m\u0131ndan kira ili\u015fkisinin \u00e7ekilmez hale geldi\u011finin kabul\u00fcne yeter delil bulunmamaktad\u0131r. Davac\u0131n\u0131n dayand\u0131\u011f\u0131 \u201ctutanak\u201d adl\u0131 belgeler kirac\u0131n\u0131n komsulara her y\u00f6nden rahats\u0131zl\u0131k verdi\u011fine ili\u015fkin olup somut bir bilgi i\u00e7ermemektedir. Davac\u0131 tan\u0131klar\u0131n\u0131n beyanlar\u0131nda ge\u00e7en kirac\u0131 ve ailesinin aile i\u00e7i tart\u0131\u015fmalar\u0131 kiralanan\u0131n&nbsp;tahliyesini gerektirecek \u00f6l\u00e7\u00fcde bir neden de\u011fildir. Kiralanan\u0131n d\u0131\u015f\u0131ndaki apartman\u0131n ortak mahallerine ah\u015faplardan odun y\u0131\u011fmas\u0131 da akde ayk\u0131r\u0131l\u0131k olu\u015fturmad\u0131\u011f\u0131 da de\u011ferlendirildi\u011finde, mahkemece davan\u0131n reddine karar verilmesi gerekirken kiralanan\u0131n&nbsp;tahliyesine karar verilmesi do\u011fru de\u011fildir.&#8221;<\/em> <strong>(Yarg\u0131tay 6. HD., E. 2013\/10719 K. 2013\/12541 T. 17.9.2013)<\/strong><\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>&#8220;Davac\u0131; daval\u0131n\u0131n, taraflar aras\u0131nda d\u00fczenlenen 10\/06\/2008 ba\u015flang\u0131\u00e7 ve 30\/09\/2012 biti\u015f tarihli kira s\u00f6zle\u015fmesi ile Erin\u00e7 Sitesinde yer alan sosyal tesis gazinosunda kirac\u0131 olarak bulundu\u011funu ancak kiralanan\u0131 site sakinlerini rahats\u0131z eder \u015fekilde, hi\u00e7bir uyar\u0131y\u0131 dikkate almadan akde ayk\u0131r\u0131 olarak kulland\u0131\u011f\u0131n\u0131, s\u00f6zle\u015fmenin 7, 8 ve 13. maddelerine s\u00fcrekli muhalefet etti\u011fini, kiralananda ge\u00e7 saatlere kadar y\u00fcksek sesle m\u00fczik \u00e7al\u0131nd\u0131\u011f\u0131n\u0131, site y\u00f6netiminden izin almadan turist kafilelerine yemek verildi\u011fini ve d\u00fc\u011f\u00fcn yap\u0131ld\u0131\u011f\u0131n\u0131 belirterek kira akdinin feshi ile daval\u0131n\u0131n&nbsp;tahliyesine karar verilmesini talep etmi\u015ftir.<\/em><br><br><em>Daval\u0131n\u0131n, site sakinlerine y\u00f6nelik tehdit edici s\u00f6zler s\u00f6yledi\u011fine ili\u015fkin tan\u0131k beyanlar\u0131 ve dosya i\u00e7eri\u011fi nazara al\u0131nd\u0131\u011f\u0131nda, daval\u0131 kirac\u0131n\u0131n eyleminin kiralanan\u0131 a\u00e7\u0131ktan fena kullan\u0131m\u0131n\u0131 olu\u015fturdu\u011fu , taraflar aras\u0131ndaki kira ili\u015fkisinin \u00e7ekilmez hale geldi\u011fi , art\u0131k davac\u0131 kiraya verenden bu olumsuzluklara ra\u011fmen ili\u015fkisine devam etmesinin beklenemeyece\u011fi ve bu itibarla ihtar gerekmeksizin dava a\u00e7\u0131labilece\u011fi g\u00f6zetilerek davan\u0131n kabul\u00fcne karar verilmesi gerekirken, yaz\u0131l\u0131 gerek\u00e7eyle davan\u0131n reddine karar verilmesi do\u011fru de\u011fildir.&#8221;<\/em> <strong>(Yarg\u0131tay Karar\u0131 &#8211; 3.
