Bu yaz\u0131m\u0131z\u0131n konusu da kirac\u0131n\u0131n kiralad\u0131\u011f\u0131 ta\u015f\u0131nmaz\u0131 ba\u015fkas\u0131na kiraya verip veremeyece\u011fidir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Alt Kira S\u00f6zle\u015fmesi Nedir?<\/h4>\n\n\n\n<p>Alt kira s\u00f6zle\u015fmesi; kiralayan\u0131n, kiralanan \u015feyin maliki olmas\u0131 gerekmedi\u011fi i\u00e7in, kirac\u0131 da kiralad\u0131\u011f\u0131 \u015feyi tekrar kiralayabilir. B\u00f6yle bir kira s\u00f6zle\u015fmesine alt kira denir. <\/p>\n\n\n\n<p>Bu k\u0131s\u0131mda ikili bir ayr\u0131m yapmakta fayda bulunmaktad\u0131r. Bu ayr\u0131m kira s\u00f6zle\u015fmesinden kaynakl\u0131 kullan\u0131m hakk\u0131n\u0131n devri ile kira ili\u015fkisinin devridir. Bu yaz\u0131m\u0131z\u0131n konusu alt kira s\u00f6zle\u015fmesi bir nevi kullan\u0131m hakk\u0131n\u0131n devri niteli\u011finde olup kiraya veren &#8211; ilk kirac\u0131, alt kiraya veren(ilk kirac\u0131)- kirac\u0131 aras\u0131ndaki hukuki ili\u015fki devam etmektedir.  Kira ili\u015fkisinin devrinde ise kiraya verenin yaz\u0131l\u0131 r\u0131zas\u0131yla kira ili\u015fkisi kendisine devredilen ki\u015fi, kira s\u00f6zle\u015fmesinde kirac\u0131n\u0131n yerine ge\u00e7mektedir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Kirac\u0131 Ta\u015f\u0131nmaz\u0131 Ba\u015fkas\u0131na Kiraya Verebilir  Mi?<\/h4>\n\n\n\n<p>T\u00fcrk Bor\u00e7lar Kanunu&#8217;nu uyar\u0131nca genel olarak kira s\u00f6zle\u015fmelerinde kiralan\u0131n alt kiraya verilebilece\u011fi belirlenmi\u015ftir. TBK m. 322 \u015fu \u015fekildedir:<br><br><em>&#8220;Kirac\u0131, kiraya verene zarar verecek bir de\u011fi\u015fikli\u011fe yol a\u00e7mamak ko\u015fuluyla, kiralanan\u0131 tamamen veya k\u0131smen ba\u015fkas\u0131na kiraya verebilece\u011fi gibi, kullan\u0131m hakk\u0131n\u0131 da ba\u015fkas\u0131na devredebilir.&#8221;<\/em><br><br>Ancak yine kanun koyucu konut ve \u00e7at\u0131l\u0131 i\u015fyerleri i\u00e7in genel kuraldan ayr\u0131k bir d\u00fczenleme ihdas etmi\u015ftir.<\/p>\n\n\n\n<p><em>&#8220;Kirac\u0131, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda, kiraya verenin yaz\u0131l\u0131 r\u0131zas\u0131 olmad\u0131k\u00e7a, kiralanan\u0131 ba\u015fkas\u0131na kiralayamayaca\u011f\u0131 gibi, kullan\u0131m hakk\u0131n\u0131 da devredemez.<\/em>&#8220;<\/p>\n\n\n\n<p>G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere kanun koyucu konut ve \u00e7at\u0131l\u0131 i\u015fyerleri i\u00e7in alt kiraya verilmesini kiraya verenin yaz\u0131l\u0131 iznine ba\u011flam\u0131\u015ft\u0131r. S\u00f6z konusu yaz\u0131l\u0131 izin kira s\u00f6zle\u015fmesi s\u0131ras\u0131nda al\u0131nabilece\u011fi gibi daha sonras\u0131nda da yaz\u0131l\u0131 olarak al\u0131nabilmektedir.<\/p>\n\n\n\n<p>Ancak kiraya veren alt kiraya raz\u0131 g\u00f6stermi\u015f olsa dahi esas kirac\u0131n\u0131n sorumlulu\u011fu devam etmektedir. Alt kirac\u0131, kiralanan\u0131 kirac\u0131ya tan\u0131nandan ba\u015fka bi\u00e7imde kulland\u0131\u011f\u0131 takdirde kirac\u0131, kiraya verene kar\u015f\u0131 sorumlu olaca\u011f\u0131 yine kanunda belirtilmi\u015ftir.<\/p>\n\n\n\n<p>Burada dikkat edilmesi gereken di\u011fer bir husus da  konut ve \u00e7at\u0131l\u0131 i\u015fyerleri kiralar\u0131n\u0131n 6 ay ve daha k\u0131sa olmas\u0131 halinde s\u00f6z konusu h\u00fckm\u00fcn uygulanmayaca\u011f\u0131d\u0131r. TBK&#8217;n\u0131n konut ve \u00e7at\u0131l\u0131 i\u015fyeri h\u00fck\u00fcmlerini konu alan m. 339\/1 \u015fu \u015fekildedir:<\/p>\n\n\n\n<p><em>&#8220;Ancak bu h\u00fck\u00fcmler, niteli\u011fi gere\u011fi ge\u00e7ici kullan\u0131ma \u00f6zg\u00fclenmi\u015f ta\u015f\u0131nmazlar\u0131n alt\u0131 ay ve daha k\u0131sa s\u00fcreyle kiralanmalar\u0131nda uygulanmaz.&#8221;<\/em><\/p>\n\n\n\n<p>Sonu\u00e7 olarak; konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131 d\u0131\u015f\u0131ndaki kira s\u00f6zle\u015fmelerinde aksine bir h\u00fck\u00fcm yoksa alt kira ili\u015fkisinin kurulabilece\u011fi a\u00e7\u0131kt\u0131r. 6 aydan uzun s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda ise alt kira ili\u015fkisi kurulabilmesi i\u00e7in kiralayan\u0131n yaz\u0131l\u0131 r\u0131zas\u0131 gerekmektedir.<\/p>\n\n\n\n<p>Konut ve \u00e7at\u0131l\u0131 i\u015f yerlerinde kiralayan\u0131n yaz\u0131l\u0131 r\u0131zas\u0131n\u0131n al\u0131nmadan alt kiraya verilmesi halinde i\u015fbu hal tahliye sebebi olabilecektir. <\/p>\n\n\n\n<p>Ancak bilindi\u011fi \u00fczere \u00e7o\u011fu kira s\u00f6zle\u015fmesinde kiralanan\u0131n kullan\u0131m amac\u0131 belirtilmektedir. Kirac\u0131n\u0131n  s\u00f6z konusu kullan\u0131m amac\u0131n\u0131 a\u015facak boyutta alt kiraya verme hususunun ticari boyut almas\u0131 halinde kiraya verenin mahkemeden m\u00fcdahalede ve eski hale iade talebinde bulunma imk\u00e2n\u0131 da bulunmaktad\u0131r.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Konuyla \u0130lgili Yarg\u0131 Kararlar\u0131<\/h2>\n\n\n\n<ul class=\"wp-block-list\"><li><em>Davac\u0131lar ile daval\u0131lardan Kerim aras\u0131nda yap\u0131lan 1.6.2000 ba\u015flang\u0131\u00e7 tarihli ve bir y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesinin \u00f6zel \u015fartlar 2. maddesinde kirac\u0131n\u0131n devir hakk\u0131n\u0131n bulunmad\u0131\u011f\u0131 belirtilmi\u015ftir. Daval\u0131lardan Kerim\u2019in di\u011fer daval\u0131 K\u2026 Limited \u015eirketinin orta\u011f\u0131 oldu\u011fu, s\u00f6z konusu \u015firketin 1995 tarihinden beri faaliyet g\u00f6sterdi\u011fi anla\u015f\u0131lmaktad\u0131r. Dinlenen daval\u0131 tan\u0131klar\u0131 kiralanan\u0131 1995 tarihinden beri daval\u0131 \u015firketin kulland\u0131\u011f\u0131n\u0131, zaman zaman davac\u0131lar\u0131n kiralanana u\u011frad\u0131klar\u0131n\u0131, kiralanan\u0131 daval\u0131 \u015firketin kulland\u0131\u011f\u0131n\u0131 bildiklerini ve ses \u00e7\u0131karmad\u0131klar\u0131n\u0131 s\u00f6ylemi\u015flerdir. <strong>Dosyada mevcut 2000 ve 2001 y\u0131llar\u0131na ili\u015fkin banka ekstrelerinden baz\u0131 aylar kiralar\u0131n\u0131n da daval\u0131 \u015firket taraf\u0131ndan davac\u0131lar\u0131n banka hesab\u0131na yat\u0131r\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bu durumda ihtarname tanzimine kadar kiralanan\u0131n daval\u0131 \u015firket taraf\u0131ndan kullan\u0131lmas\u0131na davac\u0131lar\u0131n z\u0131mnen muvafakat ettikleri, akde ayk\u0131r\u0131l\u0131\u011f\u0131n giderilmesi i\u00e7in daval\u0131lara g\u00f6nderilen ihtarnamenin 3.8.2001 tarihinde ke\u015fide edildi\u011fi davan\u0131n uzun bir s\u00fcre ge\u00e7tikten sonra 5.6.2003 tarihinde a\u00e7\u0131ld\u0131\u011f\u0131, davac\u0131lar\u0131n bu davran\u0131\u015flar\u0131yla da kiralanan\u0131n daval\u0131 \u015firkete devrine z\u0131mnen muvafakat ettikleri, sonradan dava a\u00e7malar\u0131n\u0131n iyi niyet kurallar\u0131 ile ba\u011fda\u015fmayaca\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan<\/strong> davan\u0131n reddine karar verilmesi gerekirken, yaz\u0131l\u0131 gerek\u00e7e ile istem gibi karar verilmesi hatal\u0131d\u0131r.<\/em> <strong>(Yarg\u0131tay 6. HD. E. 2004\/10420 K. 2005\/772 T. 8.2.2005)<\/strong><\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><em>Alt kirac\u0131n\u0131n mal\u0131 kullanma hakk\u0131n\u0131n kapsam\u0131 ve s\u00fcresi as\u0131l kirac\u0131n\u0131n hakk\u0131 ile s\u0131n\u0131rl\u0131d\u0131r. Alt kirac\u0131, kiralanan\u0131 kirac\u0131dan daha uzun bir s\u00fcre i\u00e7in kullanamaz (Oser \/ Sch\u00f6nenberger, Art. 264, Nr. 6; BGE 39 II 704). Zira alt kirac\u0131n\u0131n kiralanan\u0131 kullanma olgusu ba\u011f\u0131ms\u0131z bir hakka de\u011fil ve fakat m\u00fcnhas\u0131ran kirac\u0131n\u0131n hakk\u0131na ba\u011fl\u0131 bir yetkiye dayanmaktad\u0131r (Helwig, Konrad: Wesen und subjektive Begrenzung der Rechts Kraft, Leipzig 1901, sh. 28; Kuttner, Georg: Di\u011fe Privatrechtlichen Neben Wirkungen der Zvilurteile, M\u00fcncehen 1908, sh. 110). von Tuhr&#8217;un da i\u015faret etti\u011fi gibi, ikinci kirac\u0131 birinci kirac\u0131n\u0131n kira s\u00f6zle\u015fmesinden do\u011fan haklar\u0131n\u0131 onun ad\u0131na kullanan bir kimse durumundad\u0131r (Feyzio\u011flu, sh. 487). Bundan ayr\u0131 olarak alt kira s\u00f6zle\u015fmesi, (ilk kira s\u00f6zle\u015fmesi) ayakta kald\u0131\u011f\u0131 s\u00fcrece ge\u00e7erlidir ve ilk kira s\u00f6zle\u015fmesinin feshi ile alt kira s\u00f6zle\u015fmesi de kendi\u011filinden fesholunmu\u015f say\u0131l\u0131r.<\/em> <strong>(Yarg\u0131tay 3. HD., E. 2002\/4011 K. 2002\/4827 T. 02.05.2002)<\/strong><\/li><\/ul>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><em>Dava, i\u015fyeri devrinden kaynaklanmakta olup, taraflar aras\u0131nda \u00e7eki\u015fmesiz oldu\u011fu \u00fczere daval\u0131 kirac\u0131 oldu\u011fu ve alt kiraya verme yetkisi bulunmad\u0131\u011f\u0131 i\u015f yerini davac\u0131ya devretmi\u015f oldu\u011fundan ve mal sahibinin de bu devre r\u0131za g\u00f6stermedi\u011fi dosya i\u00e7eri\u011fiyle sabit oldu\u011fundan, yanlar aras\u0131ndaki s\u00f6zle\u015fmede de, herhangi bir ayr\u0131ma gidilmeden i\u015f yerinin 10.000,00-TL kar\u015f\u0131l\u0131\u011f\u0131nda devredildi\u011fi beyan edildi\u011finden, s\u00f6z konusu tutar\u0131n \u00f6denmesi i\u015f yerindeki faaliyetin devam edece\u011fi d\u00fc\u015f\u00fcncesiyle \u00f6denen bir tutar oldu\u011fu hayat\u0131n ola\u011fan ak\u0131\u015f\u0131 gere\u011fidir. Kiralayan\u0131n izin vermemesi nedeniyle davac\u0131n\u0131n i\u015f yerinde faaliyetine devam etmesi m\u00fcmk\u00fcn olmad\u0131\u011f\u0131ndan, bu nedenle \u00f6denen paran\u0131n daval\u0131 y\u00f6n\u00fcnden sebepsiz zenginle\u015fme te\u015fkil edece\u011fi tabiidir. Bu itibarla mahkemece, gerekti\u011finde tan\u0131k beyanlar\u0131na da ba\u015fvurulmak suretiyle i\u015f yerinde devir esnas\u0131nda ne kadar malzeme bulundu\u011fu ve bunun tutar\u0131n\u0131n ne oldu\u011fu uzman bilirki\u015filere hesaplatt\u0131r\u0131l\u0131p, bu miktar\u0131 a\u015fan k\u0131sm\u0131n bedelinin istirdat\u0131na karar vermek gerekirken davan\u0131n tamamen kabul\u00fcne karar verilmesi do\u011fru g\u00f6r\u00fclmemi\u015f, karar\u0131n daval\u0131 yarar\u0131na bozulmas\u0131na karar vermek gerekmi\u015ftir. <\/em><strong> (Yarg\u0131tay 11. HD., E. 2010\/13784 K. 2012\/5419 T. 05.04.2012)<\/strong><br><\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><em>\u015eu hususun da a\u00e7\u0131klanmas\u0131nda yarar vard\u0131r: 6570 say\u0131l\u0131 yasaya tabi ta\u015f\u0131nmazlarda da as\u0131l kirac\u0131n\u0131n kira s\u00fcresi bittikten sonra, onun kirac\u0131s\u0131n\u0131n ikinci kirac\u0131l\u0131k s\u0131fat\u0131 zeval bulur (Bkz. Mustafa El\u00f6ve, \u0130BD. C.XLIII, say\u0131: 7-8, y\u0131l: 1969, sh. 502; 6.HD. 10.2.1999; 4943\/576). \u00c7\u00fcnk\u00fc kirac\u0131n\u0131n kendi kirac\u0131s\u0131n\u0131 mecurdan yararland\u0131rmak hakk\u0131 s\u00f6zle\u015fmede belirtilen s\u00fcrenin bitmesi ile sona ermi\u015f bulunmaktad\u0131r.<\/em><br><br><em>Sonu\u00e7: Alt kirac\u0131n\u0131n ta\u015f\u0131nmaz\u0131 kullanma hakk\u0131n\u0131n kapsam ve s\u00fcresinin as\u0131l kirac\u0131n\u0131n hakk\u0131 ile s\u0131n\u0131rl\u0131 bulunmas\u0131na ve bunun do\u011fal sonucu olarak ilk kira s\u00f6zle\u015fmesinin feshi ile alt kira s\u00f6zle\u015fmesinin de kendili\u011finden feshedilmi\u015f say\u0131laca\u011f\u0131na g\u00f6re davac\u0131n\u0131n davaya konu etti\u011fi s\u00fcbjektif hak olan (kira ili\u015fi\u011fi) ile bir ilgisinin kalmad\u0131\u011f\u0131n\u0131 kabul etmek ve davay\u0131 taraf s\u0131fat\u0131 yoklu\u011fu nedeniyle reddetmek gerekecektir. <\/em><strong>(Yarg\u0131tay 3.
